DENIED CLAIMS AND APPEALS

What should I do if my VA claim is denied?

A denial is not the end of the road. If your claim was denied, you have the right to appeal. Under the Veterans Appeals Improvement and Modernization Act of 2017, you have three appeal options:

  1. Higher-Level Review: Request a senior VA official to reexamine your original claim for errors.

  2. Supplemental Claim: Submit new and relevant evidence to support your case.

  3. Board of Veterans’ Appeals: Take your case to a veterans law judge for a comprehensive review or hearing.

If your claim was denied before February 2019, the legacy appeals process may still apply. We’ll guide you through the steps and deadlines to ensure your appeal is filed correctly.

Will you qualify for any of the Veterans Pension Benefits?

To Qualify the Veteran Must Have…

  1. 90 Days of active duty
  2. 1 day of service during a qualifying war time period
  3. Honorable discharge

06/02/1950 - 01/31/1955

Unfortunately, many of the eligible beneficiaries are initially denied these benefits when a claim is filed. Applicants should be aware that the decisions for these claims can be appealed by veterans and their eligible family members.
